Terms and Conditions

By placing an order, scheduling an appointment, or using ReneGonzMedia’s services, the client confirms they have read, understood, and agreed to the following terms. Any project-specific terms agreed to in writing will control where they conflict with these general terms.

1. On-Site Production & Guidelines

Property Readiness: The property must be fully photo-ready at the scheduled appointment time. This includes cleaning, decluttering, staging, turning on lights, opening blinds, removing vehicles, and securing pets. ReneGonzMedia is not responsible for preparing, cleaning, staging, or moving personal items. If the property is not ready, ReneGonzMedia may shoot as-is, limit coverage, or require a reschedule. Any additional services or charges will be communicated to the client.

Access & Delays: Clients are responsible for providing complete and accurate access information, including gate codes, lockbox details, alarm instructions, and entry instructions. A 20-minute grace period is allowed for access or staging delays. Delays exceeding 20 minutes due to lockbox issues, late arrivals, occupants, or other circumstances outside ReneGonzMedia’s control will incur a $25 wait-time fee. Continued delays may result in reduced coverage or rescheduling. Any further charges will be communicated before additional work proceeds.

Weather, Drone & Safety: Outdoor and drone services are subject to weather, lighting, FAA regulations, airspace restrictions, and safe operating conditions. ReneGonzMedia may modify, substitute, reschedule, or cancel affected services if conditions are unsafe or likely to negatively affect media quality. Drone coverage is not guaranteed at every property. Any adjustment to the scope or price of affected services will be communicated to the client.

Reshoots & Return Trips: Return trips required because of property readiness, access issues, staging problems, construction, or client-requested changes to weather or lighting conditions are not included in the original booking and will be quoted separately. If a return trip is required to correct a production error attributable to ReneGonzMedia, the affected service will be corrected without an additional production fee.

2. Creative Process, Editing & Delivery

Creative Style: All media is captured and edited in ReneGonzMedia’s professional artistic style. Editing, pacing, music selection, framing, and color balance are subject to ReneGonzMedia’s creative judgment unless otherwise agreed in writing before the appointment. Minor visual differences may occur because of lighting, weather, property conditions, display settings, or platform compression.

Revisions & Advanced Retouching: Reasonable minor revisions within the original scope may be provided at ReneGonzMedia’s discretion. Object removal and advanced retouching start at $15 per image, depending on complexity. Complex virtual changes, extensive edits, additional video versions, or stylistic alterations outside the original scope require a separate quote. Reshoots are not included except as stated in these terms or the written booking agreement.

RAW Files & Unedited Footage: Standard packages include only the final edited deliverables described in the booking or quote. RAW photo files, unedited video footage, original camera files, and editing project files are not included unless expressly agreed in writing. Projects specifically booked for raw-only coverage will include the source deliverables stated in the approved quote.

Selected RAW photos or usable unedited video clips may be available as a paid add-on, subject to file availability and ReneGonzMedia’s approval. Starting add-on prices for an existing shoot, per property, are:

• Selected RAW photo files corresponding to the delivered images: $150.

• Selected usable interior/exterior video clips: $200.

• Selected usable drone video clips: $100.

• Selected usable interior/exterior and drone video clips together: $275.

• Basic normal-color Rec.709 conversion: an additional $100, with final pricing based on footage volume and processing requirements.

These prices are additional to the original service fee. Large properties, lengthy shoots, commercial projects, additional coverage, and broader usage rights require a custom quote.

Pricing, file formats, included coverage, and delivery timing must be confirmed in writing. Payment is required before source files are released. Test shots, duplicates, unusable captures, editing project files, and third-party assets such as licensed music are excluded.

Unedited video may be supplied in its original camera color profile, including Log, and may require compatible software and professional processing. Normal-color Rec.709 conversion, color correction, stabilization, audio cleanup, and other processing are excluded unless specifically included in the quote.

Providing source files does not transfer copyright. Clients may edit supplied files for uses permitted under the agreed license, but may not resell or sublicense them. ReneGonzMedia is not responsible for edits made by clients or third parties.

Delivery & Archiving: Final media is delivered digitally. Delivery timelines are estimates unless a specific deadline is agreed to in writing. Clients are responsible for downloading and backing up their deliverables promptly. ReneGonzMedia does not guarantee long-term storage of delivered media, source files, or project files. Requests for source files or replacement downloads after delivery are subject to availability.

3. Scheduling & Financials

Payment Terms: Payment timing will be stated in the booking, quote, or invoice. If no other arrangement is agreed to in writing, full payment is due before final media is released. ReneGonzMedia may withhold final media until the full balance, including applicable and disclosed travel, rush, wait-time, cancellation, processing, or platform fees, is paid.

Additional Services & Fees: Services outside the approved scope require an additional quote or client approval. Applicable travel charges, rush fees, payment-processing fees, and other charges will be disclosed at booking or before the additional service is performed.

Cancellations & Rescheduling: Cancellation or rescheduling requests should be made as early as possible. A $75 same-day cancellation fee applies when the client cancels or requests to reschedule on the scheduled day of service.

Missed appointments, inaccessible properties, or properties that cannot be photographed because they are not ready may be treated as a same-day cancellation. If ReneGonzMedia has already traveled to the property, a disclosed travel or trip fee may also apply. Any replacement appointment is subject to availability.

Client cancellation fees do not apply when ReneGonzMedia cancels or reschedules because of unsafe conditions or circumstances attributable to ReneGonzMedia.

4. Licensing & Legal

Usage License: ReneGonzMedia retains copyright and intellectual property rights in the media it creates. Upon full payment, the client receives a limited, non-exclusive, non-transferable license to use the delivered media to market the specific property and for related self-promotion, unless a different scope is agreed to in writing.

The client may provide media to their brokerage, listing platforms, hosting platforms, or marketing service providers solely to carry out these permitted uses on the client’s behalf. This does not grant those parties independent usage rights.

Media may not be sold, sublicensed, transferred for independent use, reused to market another property, or used for an unrelated project or commercial purpose without written permission. Commercial, brand, and raw-only projects will follow the usage scope stated in their approved quote or agreement. Purchasing source files does not transfer copyright or expand the license.

Authority & Permissions: The client is responsible for obtaining authorization to access and photograph the property and any necessary permissions from owners, occupants, or people participating in the production.

No Guaranteed Marketing Results: ReneGonzMedia does not guarantee specific marketing, booking, rental, or sales results, including listing performance, buyer interest, showings, offers, occupancy rates, or sale outcomes.

Limitation of Liability: To the extent permitted by applicable law, ReneGonzMedia will not be liable for indirect or consequential damages, lost profits, lost listing exposure, or lost business opportunities arising from the services. Total liability for a claim relating to a specific service will not exceed the amount actually paid for that service. These limitations do not exclude liability that cannot lawfully be limited.

Client Responsibility & Indemnification: To the extent permitted by applicable law, the client agrees to indemnify ReneGonzMedia against third-party claims arising from the client’s failure to obtain required permissions, inaccurate access information, undisclosed unsafe property conditions, or unauthorized use of the media. This obligation does not apply to the extent a claim results from ReneGonzMedia’s negligence or willful misconduct.

Dispute Resolution: The parties will first attempt to resolve disputes through good-faith discussion. If a dispute cannot be resolved, it will be submitted to binding arbitration in Arizona, except for eligible claims brought in small claims court or matters that applicable law does not permit to be arbitrated. To the extent legally enforceable, the parties waive a jury trial for arbitrable disputes and agree to resolve claims individually rather than through a class proceeding.

Governing Law: These terms are governed by Arizona law, subject to applicable federal law. If a provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
